INTERPRETATION OF FISH


“Fish” includes any type of sea fish, brackish or freshwater fish, shellfish, water snails, coral, trepang and other aquatic life and its production, but does not include turtles or turtle eggs


MAIN FUNCTIONS OF THE LICENSING SECTION


The Licensing Section is responsible for performing the functions as provided under Clause 4 (2) of the LKIM Act which is to regulate fish marketing, especially by licensing wholesalers, retailers, fish processors, importers and exporters.


LICENSING OBJECTIVES


1. To establish reasonable control over fish marketing by licensing all importers, exporters, processors and fish traders.
2. Regulate fish marketing activities including import / export marketing activities so that marketing activities are always controlled and comply with standards and protect traders and consumers.
3. Also play a role in obtaining transaction information from the licensee for the purpose of tracking the activity of the licensee.
4. To manage the issuance of new licenses, license renewal, license amendment and application for permission or temporary release Import / Export..

LICENSING CATEGORIES AND SCOPE


1. Import License
 This license is mandatory for companies or persons carrying out fish import activities or fish products and doing business in places that have been registered under Rule 3 (2) of the Fish Marketing Rules 2010.
2. Export License
 This license is mandatory for companies or persons carrying out fish export activities or fish products and transacting at places that have been registered under Rule 3 (2) of the Fish Marketing Rules 2010.
3. Wholesale License
 This license is compulsory for companies or persons doing business (Wholesale Market & LKIM Complex) in places that have been gazetted under Rule 3 (1) of the Fish Marketing Rules 2010.
4. Process License
 This license is mandatory for companies or persons processing fish under Rule 6 (1) of the Fish Marketing Rules 2010.
5. Auction License
 This registration license is mandatory for companies or people conducting fish auctions in Malaysia under Rule 13 (1) of the Fish Marketing Rules 2010.
6. Retail License
 This license is mandatory for retailers who do business (buy fish in the LKIM Complex) in places that have been gazetted under Rule 3 (1) of the Fish Marketing Rules 2010.
7. Temporary Permission License
 This license is granted to individuals, companies, organizations, Departments or Agencies to bring in fish for the purpose of research, exhibition, study, sampling, market experimentation and other purposes deemed necessary in accordance with Rule 24 (2), Fish Marketing Rules 2010.
